Fight Your DUI And Traffic Charges

An arrest for DUI is not a conviction. A common myth is that being arrested for DUI is “getting” a DUI. That is simply not the case. Your case begins promptly after your arrest. As soon as your case begins, you need a skilled criminal defense attorney who will fight for you.

At The Law Offices of Linward C. Edwards II, LLC in Florence and Dillon, South Carolina, we want to help you keep your record clean by defending you from your traffic and DUI charges. A DUI conviction will result in loss of driving privileges; require expensive and time-consuming alcohol awareness classes and possibly mandated treatment, and even have lifelong consequences, including making additional charges worse.

The Consequences Of A DUI

DUI charges get worse depending on how many prior convictions you have. It is important to know what is at stake in your charges:

For a first offense: $400 or 48 hours to 30 days in jail, or 48 hours of community service. If the blood alcohol concentration (BAC) is .10 to .15: $500 or 72 hours to 30 days in jail, or 72 hours of community service. If the BAC is .16 or greater: $1,000 or 30 days to 90 days in jail, or 30 days of community service.

For a second offense: $2,100 to $5,100 and five days to one year in prison. If the BAC is .10 to .15: $2,100 to $5,100 and 30 days to two years in prison. If the BAC is .16 or greater: $3,500 to $6,500 and 90 days to three years in prison.

For a third offense: $3,800 to $6,300 and 60 days to three years in prison. If the BAC is .10 to .15: $5,000 to $7,500 and 90 days to four years in prison. If the BAC is .16 or greater: $7,500 to $10,000 and six months to five years in prison.

For a fourth or subsequent offense: One year to five years in prison. If the BAC is .10 to .15: two years to six years in prison. If the BAC is .16 or greater: three to seven years in prison.

When each conviction makes any future charges much worse, we work tirelessly to keep your record from gaining additional charges.

Defending Against Other Charges

A minor who is charged with possession of alcohol faces hidden dangers in excess of the associated fine and a criminal record. This offense also carries a suspension of the minor’s driving privileges, regardless of whether the offense involved a vehicle. In addition, college scholarships and assistance programs may also be affected.

We also represent individuals in traffic ticket cases. The accumulation of traffic tickets can lead to increased insurance rates and license suspension. No matter what kind charges you are facing, make sure you have a trustworthy lawyer at your side.
